2. ONLINE SECURITY & PAYMENT METHODS
Rooster Sailing realise that one of the greatest worries that people have about purchasing on the web is that of security. This is why we have invested much time and money in the best possible systems to ensure that your data remains safe.
'Hacking' is a term used to describe the action of individuals or programs to 'break in' to computer systems with the aim of either stealing information or taking control of that system. Hacking exploits vulnerabilities caused either by bad programming or 'bad practice' in the basic set-up of the system. The Rooster Sailing Website is scanned on a daily basis by a specialist independent outside company to certify that we maintain a high level of website safety standards and good business practices.
This website is secured using SSL (Secure Sockets Layer) technology. Imagine sending a letter through the post in a transparent envelope. Anyone with access to it can see the data. If it looks valuable, they might take it or change it. An SSL Certificate establishes a private communication channel enabling encryption of the data during transmission. Encryption scrambles the data, essentially creating an envelope for message privacy.
We also offer secure payment options - You can choose to pay using PayPal or use the on-line payment gateway to pay by Credit/Debit Card. Our payment gateway is provided by Braintree; they are a global company providing secure credit card and debit card payment solutions for thousands of businesses across the UK. Braintree solely handles your card details on their secure server where they run extensive security checks and obtain card authorisation. Payments are taken at the time of processing your order on the website.
We use Cardinal Commerce in order to check your payment. This is known as PSD2 (3D Secure) check. This sits between our website provider Shopify and our payment gateway provider Braintree. This ensures a greater level of protection for the processing of your payment and ensures we are processing your payments in line with current legislation.

Cookies are small data files which are placed on your computer or other devices (such as smart ‘phones or ‘tablets’) as you browse this website. Your Information and countries outside UK
ROOSTER is a business with operations inside and outside of the United Kingdom and we use suppliers and distribution centres located across the world. Some of these locations will not offer the same level of protection for your personal data as the UK or the EU, but if we transfer your information to one of these locations we will take steps to ensure that your data and rights are protected through methods approved within the relevant Data Protection laws. Please contact us if you would like further information about how we protect your transferred information.
Keeping your Information
We will hold on to your information for as long as you continue to be a ROOSTER customer and for as long as we are required to keep it to ensure we meet our legal requirements across the globe.
If you no longer wish to be a customer you can contact our Customer Service team and request that we close your account. However, we have a legal requirement to keep some of your personal data even after you have asked us to delete it. We will only keep what we absolutely need to, and only to make sure we can meet our legal or regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our Terms & Conditions.
If you wish to unsubscribe from SMS correspondence at any time, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your provider. Message and data rates may apply.
Your Rights
You have a lot of rights relating to your personal information, these are:

5. ORDER ACCEPTANCE & PRICES
Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products from us. We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. Our acceptance of your order will take place only once we have dispatched the product(s) that you have ordered from us. Prior to dispatch of the products(s), Rooster Sailing Limited has the right to decline an order for any reason, including legal and regulatory reasons.
The duration of our contract with you will start from when you receive the order dispatch email and until the last day of your right to return the products. If we cannot supply you with the product you ordered, we will not process your order, inform you of this in writing (including email) and, if you have already paid for the product, refund you in full as soon as reasonably possible.
If the fulfilment of an order (or any aspect of it) would be illegal or unlawful, including by reason of breach of export controls or sanctions rules, Rooster Sailing Limited has the right to stop or cease to fulfil at any time, including after dispatch or product and/or notification to you that the order has been received and is being processed. You acknowledge that Rooster Sailing Limited shall incur no liability in such circumstances.
Purchases made from our UK website will include VAT but will be excluded for orders received that include either child size clothing or are outside the tax jurisdiction of the United Kingdom for UK Value added tax collection.
Purchases made from our EU website for delivery to a EU country will include local VAT and Duty included within the retail price paid. We choose to do this as we fulfil these orders from the United Kingdom. We use a Duty Delivery paid service in order to deliver these orders to you. All deliveries to countries outside the EU will need to pay the Local VAT and Duty charges.

The Offer:
Choose any 3 items eligible for the Mix and Match offer, add them to your basket, and enjoy 25% off each item.
If You Return an Item:
You are welcome to return any item from this offer. However, returning an item will reverse the discount applied to the remaining items, which will then be charged at full price. The adjustment will be calculated based on the value of the item you return.
How to Return:
Follow our standard return process and ensure you mark the return as a Mix and Match offer product.
Eligibility and Usage
Promo codes are issued by Rooster and are valid only on purchases made through our website, Promo codes are non-transferable, non-refundable, and cannot be exchanged for cash.
Application of Promo Codes
Promo codes must be entered at the time of checkout in the designated “Promo Code” or “Discount Code” field. Discounts will be applied only if the promo code is valid and has been correctly entered before completing the purchase. Promo codes cannot be applied retroactively to previous orders.
One-Time Use and Combinability
Unless stated otherwise, promo codes are limited to one use per customer and cannot be combined with other discounts, offers, or promotions. Only one promo code can be used per order.
Validity Period and Expiration
Promo codes are valid for a limited time only and will expire on the date specified in the promotional communication or on the website. We reserve the right to modify or cancel any promo code at any time without prior notice.
Exclusions and Restrictions
Promo codes may be subject to additional restrictions, such as minimum order value, specific product exclusions, or applicability to certain categories. These restrictions will be clearly stated in the promo code details. Shipping, taxes, and other fees are generally excluded from discounts unless explicitly mentioned.
Misuse and Abuse of Promo Codes
Promo codes are issued to individual customers and are intended for personal use only. We reserve the right to refuse or cancel orders if fraud, tampering, unauthorized use, or abuse of a promo code is suspected. Multiple accounts or other strategies used to circumvent single-use restrictions may result in the cancellation of all associated orders.
Changes and Termination
We reserve the right to modify, suspend, or terminate any promo code or promotion at any time for any reason, including the prevention of fraud, compliance with legal requirements, or any other reason at our discretion.
Limitation of Liability
We are not responsible for promo codes that are lost, stolen, expired, or used without permission. In the event of a dispute regarding the terms of any promo code, Rooster’s decision shall be final and binding.

Governing Law
These terms and conditions shall be governed by the laws of United Kingdom, without regard to its conflict of laws principles.
6. DIGITAL DOWNLOADS
All transactions for purchased Digital Downloads Content are final, and we do not accept returns of such Digital Content. You may cancel an order for purchased Digital Downloads Content within 48 hours of purchase or rental (or, for customers in the European Union, within 14 days from the date of purchase or rental) by removing your order from your basket and cancelling the payment, except that you may not cancel an order for Purchased Digital Download Content once you have started watching or downloading such Digital Content.
6.1 Limited License to Digital Download Content. Subject to payment of any charges to Digital Download Content, and your compliance with all terms of this Agreement, Rooster grants you a non-exclusive, non-transferable, sub-licensable, limited license, during the applicable Viewing Period, to access and view the Digital Download Content in accordance with the Usage Rules, for personal, non-commercial, private use.
6.2. Availability of Purchased Digital Download Content. Purchased Digital Download Content will generally continue to be available to you immediately for download or streaming from this Digital Download Service.
6.3 Playback Quality; Streaming. The playback resolution and quality of the Digital Download Content you receive will depend on a number of factors, including the type of Compatible Device on which you are accessing the Digital Content and your bandwidth, which may increase or decrease over the course of your viewing. If we detect that Digital Content we are streaming to you may be interrupted or may otherwise not play properly due to bandwidth constraints or other factors, we may decrease the resolution and file size of the streamed Digital Content in an effort to provide an uninterrupted viewing experience. While we strive to provide you a high quality viewing experience, we make no guarantee as to the resolution or quality of the Digital Content you will receive when streaming, even if you have paid extra for access to high definition, ultra-high definition, or high-dynamic-range content.
6.4 General Restrictions. You may not (i) transfer, copy or display the Digital Download Content, except as permitted in this Agreement; (ii) sell, rent, lease, distribute, or broadcast any right to the Digital Download Content; (iii) remove any proprietary notices or labels on the Digital Download Content; (iv) attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management or other content protection system used as part of the Service; or (v) use the Service or Digital Download Content for any commercial or illegal purpose.
7. PRODUCT DESCRIPTIONS
Rooster Sailing Limited attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition. If you're worried about sizing or what to buy please contact our customer service team.
8. UNDER 18'S
Rooster Sailing does not distance sell products for purchase by children. We sell under 18's products for purchase by adults. If you are under 18, you may use Rooster Sailing shop only with the involvement of a parent or guardian.
9. DELIVERY, TAX & DUTIES
We aim to process your order in conjunction with the delivery option you have selected. When you place an order, you have a choice of delivery options. Please note that express deliveries placed before 15:00 GMT on a working day shall be processed for delivery on the next working day. (Business working days exclude weekends and bank holidays)
Our carriers occasionally experience operational difficulties and therefore these service delivery times are not guaranteed. Where an order is to be delivered to an address outside of mainland UK, it is possible sometimes that a shipping price quoted shall not be correct. We therefore reserve the right to amend this. In these circumstances, we shall always contact the customer prior to any change. Please note that areas in the Scottish Highlands may absorb more shipping costs based on location and courier terms.
If you place an order from one of our websites and are outside the UK, you should note that while we do our best to provide accurate shipping times this may vary and is subject to local postage and restrictions.

We will ensure that we send your parcel using shipping terms Duty, Delivery Paid (DDP). The shipping price you pay in addition will be quoted to you at the checkout stage. This does not include any local cost that may be put in place by the delivery country

If you have placed your order on our UK website: www.roostersailing.com, the price you pay for a product does not include duty and tax, therefore if you are outside the UK, you will need to pay any additional tax and duty the courier may invoice you for before the handover the parcel to you.

11. RETURNS POLICY
3 for 2 offers returns:
If you return an item from the 3 for 2 offers, the cost of the free item will be deducted from your total refund amount.
Mainland UK/International Returns from our UK website (www.roostersailing.com)
Holiday Season returns: Any orders placed over the Holiday Season from the 1st November 2024 have extended returns until 31st January 2025. this does not affect standard returns.
Easy Returns: Provided by Royal Mail
We have partnered with Royal Mail for providing you a hassle free returns service.

Please make sure that your return complies with the following points:
- Must be in original packaging, and packaged/folded as per purchase.
- Goods must be returned in re-sellable (unused) condition
- Must be accompanied with a completed returns form, which can be downloaded here.
- Must be returned within 30 calendar days of purchase for a full refund.
Returned goods are inspected in our returns department and refunds are carried out within 14 calendar days. If replacement goods are required, they must be re-ordered from our website.
Combo deals:
Given the nature of these orders, please ensure you return all items together for a refund.
Manufacturing Fault:
If you believe a product of ours to be faulty from the time you made the purchase, please make us aware of this within one calendar month or when you first go to use the product. The item must be returned in unused condition.
From the 1st December ,Mainland UK returns will cost £4.50 per return. The return charge will be deducted from the amount we refund you when processing the return.
Orders returned from any other location must be sent back to Rooster at your own cost.
Prize Scheme Exchange
We are very happy to exchange items for a different size or colour where possible, but we are unable to swap or exchange them for a different product. Customers are required to fund the return and delivery of a replacement item.
European returns from our EU website: europeroostersailing.com
Customers who have placed an order from our European website must ensure they send any unwanted goods back to our EU Warehouse address. European customers are responsible for the cost of sending the goods back to us. We recommend using a tracked service.
We will process these returns for a full refund within 14 calendar days.

12. ROOSTER PRODUCT GUARANTEES
All products are fully warranted up to the purchaser against defects in materials and workmanship for 1 calendar year. This excludes items which are not made by Rooster. If a problem develops with a third party product we sell, we will then contact the manufacturer for a resolution.
If a Rooster branded product fails due to a manufacturing defect we will either repair the product without charge, replace the product or credit the product at our discretion. This warranty does not cover damage caused by accident, improper care, negligence, laundering, normal wear and tear, or the natural breakdown of colours and materials (outside of recommended use).
13. CUSTOM PRODUCTS RETURNS POLICY
Customised Clothing
Custom clothing products sold to you with a customised/personalisation applied/affixed to the garment will be subject to different return arrangements. We do not accept returns on customised/personalised products that have been bought from Rooster Sailing Ltd. This includes all Rooster clothing that has custom logos/text printing added to the standard clothing item.
A typical example will be when you have purchased the incorrect size, however if your product has developed a manufacturing issue then we will be happy to deal with this for you and ask you to contact the customer service team accordingly and we will be pleased to either repair or replace your item. For further statutory advice on the return of customised products please review the .gov website to understand your rights in this regard.
Custom Rope and Rigging
We do not accept returns of custom rigging wire both standing and running rigging and all rope/cord cut to your specific length.
Lengths Rooster Sailing quoted on our rigging guide are suggested lengths and customers should always verify and check before ordering any cut rope and wire is the correct length for their specific sailboat and / or application.
Custom Carbon Rooster Tiller Extentions
We do not accept returns of custom Rooster carbon tillers where the tube has been cut down either by specific instruction to Rooster or cut by the customer from the standard product length to your specific length. However if your carbon product has developed a manufacturing issue then we will be happy to deal with this for you and ask you to contact the customer service team accordingly and we will be pleased to either repair or replace your carbon item.
Custom Mast and Booms
We do not accept returns of custom masts or booms where they have been machined to customers instructions. such as special cut outs, specific lengths or additional fittings added. If your mast or boom has developed a manufacturing issue then we will be happy to deal with this for you and ask you to contact the customer service team accordingly.
Customising Wetsuit Products
The Rooster wetsuits and longjohns have the option for the sleeve and leg to be shortened to suit an individual's arm or leg length. Rooster Sailing does not accept returns of such clothing items where they have been 'cut down' or shortened by customers.
14. DELAYS
The time for completion of our work and completion of orders is given in good faith, but is not guaranteed. Rooster sailing shall not be responsible for any delay unless it arises from our wilful acts or negligence.
15. SUB-CONTRACTING
We may sub-contract all or part of the work entrusted to us by the customer, on terms that any such sub-contractor shall have all the rights and benefits contained in these Terms and Conditions. Where we exercise this right we shall remain responsible to the customer for the performance of our subcontractor.
16. STOCK LEVELS
All of our products are offered subject to availability. If for any reason we cannot supply you with any part of your order, we will contact you via email or telephone to advise you. We may need to cancel or refund the item from your order, if funds have been debited, they will be refunded back to the source of payment.
17. ENVIRONMENTAL POLICY
It is part of our environmental policy that we may use recycled materials such as used cardboard boxes and bubble wrap for our customers goods packaging.
18. LOYALTY POINT SCHEME
Effective 1st April 2023- You as a customer are able to earn loyalty points when purchasing products from our UK website, which can be redeemed for vouchers or discounts.
- Points do not have monetary value, except to the extent specifically provided for by a reward. Points are not property and cannot be redeemed as cash.
- Points will be awarded for eligible transactions made in our application for loyalty program members.
- Users must be signed up to our program to begin earning points. Points cannot be backdated nor transferred from other user accounts- even that of the same user.
- Under no circumstances can points be sold. We withhold the point to limit point earning eligibility on discounted or promotional purchases.your points balance will be displayed within you loyalty account.
- Ways to earn: There are many ways to earn points from signing up to completing reviews. All can be viewed in the Loyalty section of the website. For every £1 you spend you will earn 5 Rooster Points.
- Ways to Redeem: when you reach 1000 Rooster Points you have the option to access free delivery up to the cost of £20. When you reach 1500 Rooster Points you have the option to redeem a £15 gift voucher or a free Aquafleece neck gaiter in the colour of your choice. The value of Rooster Points when redeeming is 1 Rooster Point= 1 penny.
- Refer a friend: You can refer a friend to receive a £5 voucher when your friend places their order through the link that you have provided them with.
19. COMPETITIONS
From time to time, Rooster Sailing promotes competitions on-line. Any such competition will be conducted in accordance with the following terms and conditions.
Your statutory rights are not affected by these terms and conditions.
19.1 General Terms
19.1.1: These terms and conditions together with any specific rules set out in Competition Notices (as defined below) are the Competition Rules ("Rules") and apply to competitions advertised on the Rooster Sailing Ltd website (www.roostersailing.com) (“Website”), in e-mail newsletters (“Newsletter”), and by text message ("SMS") issued by the above ("Competition"), unless otherwise expressly stated.
19.1.2 By entering a Competition, entrants agree to be bound by these Rules.
19.1.3 The Competition is organised by Rooster Sailing Ltd. of Unit F2-F3 Fort Wallington Industrial Estate, Military Road, Fareham, Hampshire, PO16 8TT, United Kingdom ("Rooster Sailing Ltd").
19.1.4 Rules specific to each Competition are displayed in a notice on the Website or Newsletter for such Competition ("Competition Notice") and are incorporated into the Rules. In the event of discrepancy between these terms and conditions and the Competition Notice, the Competition Notice shall prevail.
19.1.5 Rooster Sailing Ltd reserves the right to cancel or amend the Competition or the Rules without notice in the event of a catastrophe, act of God, war, civil or military disturbance or any actual or anticipated breach of any applicable law or regulation or any other event outside the reasonable control of Rooster Sailing Ltd. Any changes will be posted either within these terms and conditions or the Competition Notice where possible. 19.1.6 In the event of any dispute regarding the rules, results, conduct and all other matters relating to a Competition, the decision of Rooster Sailing Ltd shall be final and no correspondence or discussion shall be entered into.
19.2. Qualifying Entrants
19.2.1 Employees (or members of the families or households of employees) of Rooster Sailing Ltd or any company involved in the management, issuance or promotion of the Competition or, if relevant, any advertising agency or web company connected with the Competition or any such person’s subsidiary or associated companies, are not eligible to enter the Competition. Rooster Sailing Ltd reserves the right not to award a prize (and to select an alternative winner) if Rooster Sailing Ltd is aware or has reasonable grounds to believe that a winner is not eligible.
19.2.2 Additional eligibility requirements may apply to a specific Competition, which will be set out in the Competition Notice, for example the need for a valid passport.
19.2.3 By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. Rooster Sailing Ltd reserves the right to verify the eligibility of all entrants.
19.2.4 The address you provide with your competition entry ("Entry") will be used to send any prizes. Unless stated otherwise in the Competition Notice, Competitions are only open to residents of the United Kingdom.
19.2.5 Where a Competition is open to all age groups, Rooster Sailing Ltd assumes that by using the Website and entering the Competition (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Competition and these Rules. If a Competition is only open to a certain age group (e.g. 18 and over), this will be set out in the Competition Notice and Rooster Sailing Ltd assumes that by entering the Competition (and you warrant that) you are the appropriate age to enter the Competition).
19.2.6 Rooster Sailing Ltd reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Rules.
19.2.7 In the event that any entrant is disqualified from the Competition, Rooster Sailing Ltd in its sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Rules.
19.3. Competition Entries
19.3.1 You may enter the Competition once, unless indicated otherwise in the Competition Notice, however where a winner has been selected and Rooster Sailing Ltd discovers or has reasonable grounds to believe the winner has used any software or automated process either to answer questions or to make bulk entries, Rooster Sailing Ltd may in its sole discretion select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be equally subject to these Rules.
19.3.2 Competition entries must be made in the manner and by the closing date and time specified on the Competition Notice. Failure to meet these criteria will result in disqualification from the Competition.
19.3.3 Any purchase requirement will be detailed in the Competition Notice. Failure to meet any such requirement will result in disqualification from the Competition. Return of purchased items before any specific date detailed in the Competition Notice will result in disqualification from the Competition. In the absence of a specific date in the Competition Notice, return of purchased items before the closing date or draw date (whichever is the latter) will result in disqualification from the Competition.
19.3.4 Any other requirement, for example subscribing to the Newsletter, will be detailed in the Competition Notice. Failure to meet or to continue to meet any such requirement will result in disqualification from the Competition. For example, unsubscribing from the Newsletter before any specific date detailed in the Competition Notice will result in disqualification from the Competition. In the absence of a specific date in the Competition Notice, failing to meet or to continue to meet the requirement before the closing date or draw date (whichever is the latter) will result in disqualification from the Competition.
19.3.5 Proof of submission cannot be accepted as proof of receipt. Rooster Sailing Ltd cannot accept responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of or unauthorised access to Entries, or Entries lost, damaged or delayed as a result of server functions, technical issues, virus, bugs or other causes outside the control of Rooster Sailing Ltd.
19.4. Prizes
19.4.1 Unless stated otherwise in the Competition Notice, prize winners will be chosen at random from all correct and eligible Entries or from all submitted Entries (where creative or artistic merit or other subjective criteria apply to Entries), on or after the date specified in the Competition Notice or if no date is specified, within 30 days of the closing date specified in the Competition Notice. Where applicable, tie-breakers will be judged by Rooster Sailing Ltd and, if required by law, by an independent adjudicator. In all matters, the decision of any judge(s) and Rooster Sailing Ltd shall be final and no correspondence or discussion shall be entered into.
19.4.2 Prize winners will be notified in the manner and within the time specified on the Competition Notice, or within 60 days of the closing date specified on the Competition Notice. Notification may be by any means of communication made available by the entrant, such as postal address, email or telephone. Return of any prize notification as undeliverable or failure to reply within a reasonable period determined at the discretion of Rooster Sailing Ltd may result in disqualification and selection of an alternate winner.
19.4.3 If more than one prize is awarded only one prize per entrant will be awarded. Competition winner(s)’ names may be published on the Website or for a list of winners you can send a self-addressed stamped envelope to Competition Prize Winners, Rooster Sailing Ltd, F2-F3 Fort Wallington Industrial Estate, Military Road, Fareham, Hampshire, PO16 8TT, United Kingdom, making reference to the specific competition.
19.4.4 Claims for prizes must be made in the manner and within the time specified on the Competition Notice. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.
19.4.5 Prizes are non-transferable and there is no cash alternative. Rooster Sailing Ltd reserves the right to substitute prizes of equal or greater value at any time. Delivery of prizes can only be made in the United Kingdom and Rooster Sailing Ltd undertakes to make reasonable efforts to complete delivery.
19.4.6 Prizes are awarded at Rooster Sailing Ltd’s discretion and no prizes will be awarded as a result of improper actions by or on behalf of any entrant.
19.4.7 Where a prize may not be appropriate for a younger contestant, the minimum age for entry will be stated in the Competition Notice and must be observed. Rooster Sailing Ltd reserves the right to request written proof of age of any winner.
19.4.8 All and any expenses, unless specifically stated, are the sole responsibility of the prize winner.
19.5. Intellectual Property Rights and Use of Entries
19.5.1 Rooster Sailing Ltd makes no general legal claim over ownership of an Entry. Where any Entry is to be used in a different way this will be made clear in the Competition Notice and you will then be able to choose whether to enter the Competition.
19.5.2 In consideration of Rooster Sailing Ltd agreeing to consider entrants to the Competition, each entrant hereby agrees that Rooster Sailing Ltd (and third parties authorised by Rooster Sailing Ltd) may make any and all Entries available on the Website and any other media, whether now known or invented in the future, which may include other internet sites, mobile, television and/or radio and that Entries may be made available with advertising and/or sponsorship. By entering you grant Rooster Sailing Ltd (and third parties authorised by Rooster Sailing Ltd a non-exclusive, worldwide, irrevocable licence (for the full period of any rights in the Entry) to use, display, publish, transmit, copy, make derivative works from, edit, alter, store, re-format, sell and sub-licence the Entry for such purposes.
19.5.3 Rooster Sailing Ltd does not guarantee to use or otherwise make available any Entry. Rooster Sailing Ltd may also, in appropriate circumstances, and at its sole discretion, reject, edit, remove or disable access to Entries that appear to be legally or otherwise questionable e.g. infringe of copyright or privacy rights of others, are defamatory or for any other reason.
19.5.4 Your Entry and any information submitted by you must be personal to and relate specifically to you. You hereby warrant that your Entry and all information which you submit and/or distribute will not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening. Rooster Sailing Ltd reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same.
19.6. liability
19.6.1 Rooster Sailing Ltd cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize.
19.6.2 Rooster Sailing Ltd is not responsible for any problems or technical malfunction of any telephone, computer, server, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems on the internet, telephone, or at any web site, or any combination of these, including any injury or damage to entrant’s or any other person’s computer or telephone related to or resulting from participation or downloading any materials in the Competition.
19.6.3 Nothing shall exclude Rooster Sailing Ltd’s liability for death or personal injury as a result of its negligence.
19.7. Data Protection and Publicity
19.7.1 Winners may be requested to take part in promotional activity and Rooster Sailing Ltd reserves the right to use the names and addresses of winners, their photographs and audio and/or visual recordings of them in any publicity.
19.7.2 Any personal data relating to entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to any third party not associated with the management of the Competition without the individual’s prior consent. Data relating to entrants will be retained by Rooster Sailing Ltd for a reasonable period after the Competition closes to assist Rooster Sailing Ltd in dealing with any queries on the Competition.
19.7.3 Where the Competition Notice requires sign-up to the Newsletter, data will be kept in a database for the purposes of sending the Newsletter. No details will be passed on to 3rd party organisations.
19.8. Jurisdiction
19.8.1 The Competition and Rules will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England. The Website and Newsletter are only intended to be accessed from the United Kingdom. Rooster Sailing Ltd makes no representation that materials on the Website or Newsletter relating to this Competition are appropriate or available for use at other locations and access to them from territories where their contents are illegal is strictly prohibited. 21.Sponsorship Support Policy Prize Scheme
21.1. The discount is only available on full retail price items; it is not applicable on sale, clearance and combo deals. The prize scheme code is not to be used in conjunction with any other discount codes.
21.2. The discount is only available on Rooster specific/branded products and does not include third party items. For example, chandlery and other equipment.
21.3. Requests for prize support must be submitted at least 2 weeks prior to the event to avoid unnecessary admin and shipping delays. Rooster reserves the right to reject requests if submitted late.
21.4. Returns: Event organisers are responsible for any returns for unsuitable prizes* won by participants. Rooster will not accept direct returns from the prize winner as they do not hold the sales contract. We suggest you purchase non-sized items or gift vouchers (20% off only) to reduce potential returns admin on your side. All returns are at the cost of the customer.
21.5. The code acquired for purchasing prizes must only be used on event prizes and is not for personal use. The discount code will be updated monthly and there must be evidence of the event occurring which requires prizes, prior to adding the account to the new code.
